AeroCMS – Manage Displays and Publish Content with Ease

These Terms and Conditions ("Terms") govern the access and use of AeroCMS ("AeroCMS", "Aero CMS", "AeroCMS Cloud Digital Signage", "Company", "we", "us", "our") by you ("you", "your", "customer", "reseller", "partner", "user").

By accessing or using the AeroCMS platform, website, dashboard, or applications (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, you must immediately stop using the Service.

1. Definitions

• Digital Display Site – Physical location where display screens and players are installed.
• Advertisement – Promotional or informational content displayed using AeroCMS.
• Customer – Any individual or organization using the Service.
• Billing Period – Monthly, quarterly, or annual subscription cycle.
• Content – Any media, text, video, images, or data uploaded by users.
• Hardware – Displays, media players, computers, or devices used with AeroCMS.
• Reseller – Entity purchasing subscriptions for resale.
• White-Label Reseller – Reseller offering AeroCMS under its own branding.
• Login Credentials – Username, password, API key, or access token.
• Service – AeroCMS SaaS platform and related applications.
• User – Any authorized individual accessing the Service.

2. About AeroCMS

AeroCMS is a cloud-based digital signage and content management platform designed for commercial and organizational use. Personal or non-commercial usage requires prior written approval.

3. Registration & Account Security

• Users must register to access the Service.
• All provided information must be accurate and up-to-date.
• You are responsible for safeguarding login credentials.
• AeroCMS may suspend accounts suspected of misuse or security breaches.

4. AeroCMS Responsibilities

• Provide access to content scheduling and publishing tools.
• Offer support and maintenance based on the subscribed plan.
• Use reasonable efforts to maintain system availability.

5. Contract Term & Termination

• You must be at least 18 years old to use the Service.
• Subscriptions renew automatically unless canceled.
• AeroCMS may terminate access for policy violations, fraud, or misuse.
• Upon termination, access to content may be removed.

6. Access, Availability & Support

• Service availability is not guaranteed to be uninterrupted.
• Downtime may occur due to maintenance or third-party services.
• Support is provided via official AeroCMS channels during business hours.

7. User Obligations

You agree not to upload or display content that:

• Is illegal, defamatory, obscene, or harmful
• Violates intellectual property rights
• Contains malware or malicious code
• Promotes hate, violence, or illegal activities

You warrant that you own or have rights to all uploaded content and indemnify AeroCMS against any related claims.

8. Fees & Payments

• Fees are charged per display as per the selected plan.
• Displays linked to an account are billable even if offline.
• All fees are non-refundable unless stated otherwise.
• Applicable taxes, including GST, will be added.

9. Free Plan

• A free plan may be offered with limited features.
• AeroCMS may modify or discontinue free plans at any time.
• Duplicate free accounts are prohibited.

10. Limitation of Liability

The Service is provided on an “as is” basis. AeroCMS shall not be liable for indirect, incidental, or consequential damages, including loss of data or business.

Maximum liability shall not exceed fees paid by you in the preceding 12 months.

11. Intellectual Property

• All AeroCMS software, branding, and technology remain our exclusive property.
• You may not copy, reverse engineer, or redistribute the Service.

12. Data Protection

AeroCMS processes data in accordance with applicable laws. While security measures are implemented, no system is fully secure.

13. Security & Misuse

• Unauthorized access attempts are strictly prohibited.
• Violations may result in immediate termination and legal action.

14. Marketing & Publicity

With prior consent, AeroCMS may use your name or logo for marketing purposes. You may opt out at any time.

15. Confidentiality

Both parties agree to maintain confidentiality of proprietary information even after termination.

16. Governing Law

These Terms are governed by the laws of India. Courts of the applicable jurisdiction shall have exclusive authority.
